Agreement to Terms

By accessing or using the Nobirae platform, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you do not have permission to access our services.

Nobirae provides a restaurant analytics platform that connects to your operational systems to collect, process, and visualize business data. We offer various service tiers with different features and capabilities as described on our website.

We strive to maintain service availability but do not guarantee uninterrupted access. Scheduled maintenance, technical issues, or circumstances beyond our control may temporarily affect platform availability.

Account Registration

To use our platform, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must notify us immediately of any unauthorized use of your account or any other security breach. We are not liable for losses resulting from unauthorized account use, though you may be liable for losses incurred by us or others due to such unauthorized use.

Data Access and Usage

By using our service, you grant us permission to access data from your restaurant management systems as necessary to provide analytics services. You represent and warrant that you have the right to provide this access and that such access does not violate any agreements with third parties.

You retain all ownership rights to your operational data. We use your data solely to provide services as described in our Privacy Policy. We do not claim ownership of your data and will not use it for purposes beyond service provision without your explicit consent.

Service Fees and Payment

Service fees vary based on the selected plan and are described during the registration process. Fees are billed according to the payment schedule you select. You agree to pay all fees associated with your selected service tier.

We reserve the right to modify service fees with reasonable notice. Fee changes will not affect your current billing cycle but will apply to subsequent renewal periods.

Failure to pay fees may result in service suspension or termination. We are not responsible for any losses resulting from service interruption due to non-payment.

Service Modifications

We may modify, suspend, or discontinue any aspect of the service at any time, including features, functionality, or availability of specific integrations. We will provide reasonable notice of significant changes that materially affect service functionality.

Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities, arising from your use or inability to use the service.

Our total liability for any claims arising from these Terms or your use of the service shall not exceed the amount you paid us in the twelve months preceding the claim.

Indemnification

Termination

Governing Law

These Terms are governed by the laws of Japan. Any disputes arising from these Terms or your use of the service shall be subject to the exclusive jurisdiction of the courts of Niigata, Japan.
